Welcome to Statement by Nese. By accessing this website, purchasing products, booking services, requesting custom work, or communicating with Statement by Nese, you agree to the following Terms & Conditions. These terms are designed to protect the integrity of the brand, the creative process, the owner’s time, and all original works produced under Statement by Nese.

Please read carefully before placing any order or engaging with our services.

1. Brand Ownership & Intellectual Property

All designs, product concepts, custom creations, logos, branding elements, photos, videos, graphics, captions, wording, styling concepts, packaging ideas, and creative content associated with Statement by Nese are the sole intellectual property of Statement by Nese unless otherwise stated.

You may not:

  • Copy, recreate, duplicate, trace, imitate, reproduce, or redistribute any design or concept

  • Use Statement by Nese images, branding, or content for commercial purposes without written permission

  • Send Statement by Nese designs to another creator, manufacturer, or business for duplication

  • Alter or modify products and continue marketing them as Statement by Nese creations

  • Use any part of our brand identity to create misleading or competing products

Statement by Nese reserves the right to pursue legal action against theft, imitation, misuse, or unauthorized reproduction of its creative work.

2. Custom Orders

Custom pieces are handcrafted, curated, and designed with creative discretion. By placing a custom order, you acknowledge and agree that:

  • Creative direction and artistic interpretation remain with Statement by Nese

  • Minor variations in color, texture, material placement, embellishments, or detailing may occur

  • Exact replicas of inspiration photos, celebrity looks, Pinterest images, or competitor products are not guaranteed

  • Turnaround times are estimates and may vary based on workload, material availability, holidays, shipping delays, or unforeseen circumstances

Statement by Nese reserves the right to decline any custom order request for any reason without obligation to disclose details.

3. Deposits & Payments

All deposits are:

  • Non-refundable

  • Non-transferable

  • Required before work begins

Full payment must be received before any product is shipped, delivered, or released.

Failure to complete payment within the stated timeframe may result in:

  • Cancellation of the order

  • Loss of deposit

  • Resale or repurposing of the custom item

  • Refusal of future service

Chargebacks, payment disputes, or fraudulent claims made after receiving products or services will be aggressively disputed using all available documentation, communication records, timestamps, proofs of work, shipping confirmations, and transaction records.

4. No Refund Policy

Due to the custom, artistic, luxury, and handmade nature of Statement by Nese products and services:

ALL SALES ARE FINAL.

Statement by Nese does not offer refunds, exchanges, returns, or cancellations once payment has been submitted unless otherwise stated in writing.

Refunds will not be issued for:

  • Buyer’s remorse

  • Delayed responses from customers

  • Failure to read descriptions

  • Incorrect measurements submitted by customer

  • Minor handmade variations

  • Shipping carrier delays

  • Personal preference changes

  • Event cancellations outside of our control

If an issue arises due to a direct error made by Statement by Nese, resolution options may be considered solely at the owner’s discretion.

5. Luxury Handmade Disclaimer

Every piece is handcrafted and may contain slight imperfections or natural variations that are consistent with handmade luxury artistry. These are not considered defects.

Statement by Nese prioritizes originality, craftsmanship, and exclusivity over mass production perfection.

6. Client Communication Policy

Respectful communication is required at all times.

Statement by Nese reserves the right to:

  • Refuse service

  • End communication

  • Cancel future bookings

  • Block abusive, disrespectful, threatening, manipulative, or excessively demanding individuals

Repeated excessive messaging, rush pressure, unreasonable demands, harassment, or disregard for stated policies may result in immediate termination of business relations without refund.

Business hours, response times, and creative schedules must be respected.

7. Turnaround Times & Rush Orders

Estimated turnaround times are not guarantees.

Statement by Nese is not liable for delays caused by:

  • Shipping carriers

  • Weather

  • Supplier delays

  • Holidays

  • Illness

  • Emergencies

  • High-volume order periods

  • Circumstances outside reasonable control

Rush orders may incur additional fees and are accepted only upon approval.

Customers are responsible for ordering early enough for important dates, events, photoshoots, birthdays, holidays, or travel needs.

8. Shipping & Delivery

Once packages are transferred to the shipping carrier, Statement by Nese is no longer responsible for:

  • Lost packages

  • Stolen packages

  • Delayed delivery

  • Carrier mishandling

  • Incorrect addresses submitted by customer

Customers are responsible for ensuring all shipping information is accurate before checkout.

If a package is returned due to incorrect address information, the customer is responsible for additional shipping costs.

9. Product Care & Liability

Customers are responsible for properly caring for all items purchased.

Statement by Nese is not liable for:

  • Damage caused by misuse

  • Improper storage

  • Water exposure

  • Chemical exposure

  • Excessive wear

  • Neglect

  • Unauthorized alterations or repairs

Wear and longevity vary based on usage and handling.

10. Social Media & Promotional Usage

Statement by Nese reserves the right to photograph, record, repost, and use any completed product, custom design, testimonial, tagged content, or client-submitted media for promotional, portfolio, website, social media, and marketing purposes unless otherwise agreed in writing beforehand.

11. Pricing & Policy Changes

Prices, services, product availability, policies, and terms may change at any time without notice.

Statement by Nese reserves the right to update or modify these Terms & Conditions at its sole discretion.

12. Limitation of Liability

By purchasing from Statement by Nese, you agree that Statement by Nese and its owner shall not be held liable for:

  • Indirect damages

  • Consequential damages

  • Emotional distress claims

  • Missed event losses

  • Lost profits

  • Shipping-related losses

  • Third-party issues

  • Misuse of products

Liability, if any, shall never exceed the amount paid directly to Statement by Nese for the specific product or service involved.

13. Agreement to Terms

By using this website, placing an order, submitting payment, or communicating business intent with Statement by Nese, you acknowledge that you have read, understood, and agreed to these Terms & Conditions in full.

Failure to read these policies does not exempt any customer from compliance.
